The Soldier has the option to check the disagree box. Although it is to their advantage to state why they disagree and present evidence supporting their position, they are under no requirement to write anything. The plan of action and counseling are still enforceable.
In this situation, I suggest writing the following text in the Leader Responsibilities box:
- Soldier disagreed with the counseling and refused the opportunity to prepare a written statement.
- Soldier was informed that his disagreement will not prevent the execution of the plan of action and the information discussed during this counseling session.

I have been trying to explain to my platoon sergeant and commander that the soldier may may agree or disagree and state why on a counseling but they keep telling me it’s agreeing that the admin data is correct… That makes no sense at all.

Usually this is a result of leaders being told this information at some point in their career. There is no documentation, regulation, or doctrine that supports that position. Either way it does not matter because if the counseling is fair and factual then the leaders should have no problem with a Soldier disagreeing and writing a comment. Your comment provides your side of the situation. I have work with several Soldiers that simply agreed with a counseling and later ended up in very bad situations like Article 15 or separation. Remember as a subordinate you have to be absolutely professional, factual, calm, and unemotional, no matter what. It will keep you out of trouble.
