Is emotional cheating covered under UCMJ?

A spouse is alleging emotional adultery or cheating. Is that even possible under the UCMJ?

Short Answer

WOW!  I would personally say “NO” but have seen some strange things happen

Discussion

While I do not believe it would be reasonable to pursue such a charge it might be possible under Article 134 of the UCMJ.  It would highly depend upon the circumstances, the facts, etc.  There might be another charge of abuse or some related offense but that would all depend on the facts of the issue.  The command could pursue the Good order and Discipline of the unit angle but not sure if that would fly.

Your Attitude and Tone

Your attitude and tone in handling issues like this are very important.  It is very important that you be factual, respectful, calm, and professional.  Take the high road.  If you get emotional it will not workout in your favor.
